In Oklahoma, workers’ compensation typically pays 70% of an employee’s average weekly wage for up to 52 weeks, which gives the injured victim time to see the appropriate physicians and schedule therapy and or corrective surgery. This will extend your weekly pay until you are released from medical care. The weekly maximum is based on that employee’s previous weekly wages. For example, if an employee’s previous weekly wage were $900, they would receive $600 in workers’ compensation wages but would not be further taxed. This process and the subsequent settlement is tax free.

There is a two day grace period after an injury but the workers compensation insurance is responsible for missed pay beyond that time period. This weekly pay is referred to as TTD, Total Temporary Disability. It is imperative for accident victims to be proactive and request an attorney’s assistance in setting up TTD with the work comp insurance company. This process can take up to two weeks to establish.
